Este trabajo tiene como objetivo proponer una metodología didáctica que propicie el desarrollo de pensamiento crítico; para cumplir con este cometido, se presenta un ejercicio que muestra cómo hacerlo. Los cuentos de tradición oral se constituyen en el insumo principal. Según la propuesta, su análisis e interpretación pasan por cuatro secciones: “descripción del marco literario”, “marco sociocultural”, “marco religioso”, “marco normativo”. The debate over the determination of death has been raging for more than fifty years. Since then, objections against the diagnosis of brain death from family members of those diagnosed as dead-have been increasing and are causing some countries to take novel steps to accommodate people’s beliefs and preferences in the determination of death. This, coupled with criticism by some academics of the brain death criterion, raises some questions about the issues surrounding the determination of death. On the other hand, they also underpin the regulations in force in each country to different extents. They are often used indistinctly and equivocally, despite the different ethical implications of each concept. This paper aims to clarify to what extent we can speak of altruism and solidarity in the predominant models of organ donation. (...) Background: This research explores how public awareness and attitudes toward donation and transplantation policies may contribute to Spain's success in cadaveric organ donation. Materials and Methods: A representative sample of 813 people residing in Andalusia (Southern Spain) were surveyed by telephone or via Internet between October and December 2018. Results: Most participants trust Spain's donation and transplantation system (93%) and wish to donate their organs after death (76%). Among donors, a majority have expressed their consent (59%), and few nondonors have (...) expressed their refusal (14%). Only a minority are aware of the presumed consent system in force (28%) and feel sufficiently informed regarding the requirements needed to be an organ donor (16%). Participants mainly consider that relatives should represent the deceased's preferences and be consulted when the deceased's wishes are unknown, as is the case in Spain. Conclusion: Public trust in the transplant system may contribute to Spain's high performance in organ donation. High levels of societal support toward organ donation and transplantation do not correspond with similar levels of public awareness of donation and transplantation policies in Spain. (shrink)

A partir de una reflexión más amplia sobre el _vínculo entre poder e imagen_, y de la imagen como dispositivo y potencia, enfocamos aquí la figura de José “mulato” Gil de Castro –pintor peruano inmigrante en Chile y retratista de las elites eclesiásticas, políticas y militares sudamericanas–, abordando su producción de imágenes inscritas en la _funcionalidad glorificante_ _y generadora de signos del poder soberano_ –incluso allí donde retrata al “pueblo”– en un contexto histórico en que los imaginarios soberanistas colonial y (...) estatal-nacional se organizan al hilo del discurso “humanista” de corte eurocéntrico y del racismo como reverso inmunitario de su norma antropológica. La operación artística de Gil de Castro y su contexto nos ofrecen un interesante escenario microhistórico para comprender el fenómeno de la “secularización” moderna –o “transición”–, en la medida en que la matriz en el campo religioso de su operatoria pictórica se desplaza a un campo político y militar en donde el ejercicio del poder soberano se comprende y se practica como un intento de dar forma a lo social de acuerdo a un _paradigma_ _angelológico_ con raíces en una _metafísica política_ _teo-onto-antropológica_. En el siguiente ensayo intento una consideración amplia del problema de la institución fuerte a partir de la cuestión del doblez metafórico del lenguaje y su articulación metafísico-principial. Se trata de una cuestión problemática que cabría situar como un prolegómeno posible de acceso al pensamiento Jacques Lezra en torno a una cosmología heteróclita y una república material o salvaje –pensamiento según el cual el “republicanismo salvaje” dependería de producir e instituir conceptos defectivos de asociación política que den lugar a “instituciones (...) defectivas”. Para ello apunto al trabajo de Lezra sobre la trama de relaciones entre lenguaje, institución y deconstrucción en Paul de Man; a la paradigmática reductio ad unum en la institución del lenguaje y su maximización como unidad ideal del sentido y estructura lógica del mundo en la fenomenología de Edmund Husserl; a la necrofilología de Lezra como teoría materialista de los conceptos y de la inestabilidad ontológica del mundo; y, por último, a la cuestión del principio de equivalencia y traductibilidad general en la época del capitalismo global. Requiring family authorization for apnea testing subtracts health professionals control over death determination, a procedure that has traditionally been considered a matter of clinical expertise alone. In this commentary, we first provide evidence showing that health professionals’ (HPs) disposition to act on death determination without family’s prior consent could be much lower than that referred to by Berkowitz and Garrett (2020). We hypothesize that HPs may have reservations about their own expertise as regards death, and may thus hesitate to impose (...) their views on patients’ families. We then address the theoretical question of clinical expertise in death determination by distinguishing judgments about facts (e.g., the presence or absence of spontaneous breathing) from interpretations given of these facts (i.e., their meaning for the vital status of an individual). We argue that, while clinicians may claim some expert authority on the former, they hold no particular authority on the latter. (shrink)

Notwithstanding the potential danger to security and privacy, sharing and publishing data has become usual in Data Science. To preserve privacy, de-identification methodologies guided by risk estimation have been designed. Two issues associated with classical risk metrics are, on the one hand, the adequacy of the metric and, on the other hand, its static nature. In this paper, we present metrics for estimating risk based on the emerging semantics provided by Formal Concept Analysis. The metrics are designed to estimate the (...) a priori risk of compromised data deletion. Furthermore, by applying specialized variable forgetting methods for association rules, it is shown how to reflect the effect of deleting attributes belonging to potentially dangerous quasi-identifier sets. The technical possibilities of biomedicine open up the opportunity to intervene in ageing itself with the aim of mitigating, reducing or eliminating it. However, before undertaking these changes or rejecting them outright, it is necessary to ask ourselves if what would be lost by doing so really has much value. This article will analyse the desirability of ageing from an individual point of view, without circumscribing this question to the desirability or undesirability of death. First, we will present the three (...) most widely used arguments to reject biomedical interventions against ageing. We will argue that only the last of these arguments provides a consistent answer to the question of the desirability of ageing. Second, we will show that the third argument falls prey to a conceptual confusion that we will call the paradox of ageing: although ageing entails negative health effects, it leads to a life stage with valuable goods. Both valuations, one positive and the other negative, refer to two different dimensions of ageing: the chronological and the biological. We will defend that, by not adequately distinguishing these two types of ageing, it does not become apparent that all the valuable goods exclusive to ageing derive only from its chronological dimension. Third, we will argue that, if we just conceive ageing biologically, it is undesirable. We will elaborate on the two kinds of undesirable effects biological ageing has: direct and indirect. Finally, we will respond to potential objections by adducing that these are insufficient to weaken our argument. (shrink)

We have recently stated the reasons why we claim that biological ageing is undesirable. Räsänen has responded to our article by arguing that this process has certain desirable aspects and, therefore, our position is inconsistent. Räsänen develops two arguments to defend his position. We will call the first the argument from the totality of the ageing process and the second the argument from the reduced goods of the ageing process. In this reply, we will give reasons to show that both (...) arguments fail. The first, on the one hand, starts from a dubious conception of ageing and, on the other hand, even accepting this conception, its reformulation is morally empty. En busca de un acceso al fenómeno del amor, se propone interrogarlo conforme al tipo de atención que promueve, asumiendo y discutiendo los recursos aportados por la fenomenología husserliana, así como por las fenomenologías contraintencionales, en particular la de Waldenfels. De este modo, si para describir este fenómeno es preciso dar cuenta del fundamento afectivo de la atención, también hay que reconocer que el (...) amor es vivido como un hecho original o un acontecimiento que implica para el amante una reorientación existencial y atencional. ABSTRACT The article inquires into the attentionality inherent to love as a privileged and primordial experience of care. Seeking access to the phenomenon of love, we suggest inquiring into it according to the type of attention it promotes, drawing on and discussing the resources provided by Husserlian phenomenology, as well as by counter-intentional phenomenologies, particularly Waldenfels'. Thus, while it is necessary to account for the affective grounds of attention in order to describe this phenomenon, it is also essential to recognize that love is experienced as an original fact or as an event that entails an existential and attentional reorientation of the lover. Accordingly, in this commentary, we underscore the importance of the implementation of safeguards for AI algorithms before they are deployed in clinical practice. The goal of documenting a living will and advanced directives is to convey personal (...) preferences regarding the acceptance of therapies, including life support, for future use in case of losing one’s capacity. This is standard practice in the care of incapacitated critically ill patients as it is considered to extend the individual’s autonomy. Gonzalo Rodriguez-Pereyra presents an original study of the place and role of the Identity of Indiscernibles in Leibniz's philosophy. The Principle of the Identity of Indiscernibles rules out numerically distinct but perfectly similar things; Leibniz derived it from more basic principles and used it to establish important philosophical theses. Rodriguez-Pereyra aims to establish what Leibniz meant by the Principle of Identity of Indiscernibles, what his arguments for and from it were, and to assess those arguments and Leibniz's claims about (...) the Principle of Identity of Indiscernibles. He argues that Leibniz had a very strong version of the principle, according to which no possibilia are intrinsically perfectly similar, where this excludes things that differ in magnitude alone. The book discusses Leibniz's arguments for the Identity of Indiscernibles in the Meditation on the Principle of the Individual, the Discourse on Metaphysics, Notationes Generales, Primary Truths, the letter to Casati of 1689, the correspondence with Clarke, as well as the use of the Identity of Indiscernibles in Leibniz's arguments against the Cartesian conception of the material world, atoms, absolute space and time, the Lockean conception of the mind as a tabula rasa, and freedom of indifference. Benefit sharing aims to achieve an equitable exchange between the granting of access to a genetic resource and the provision of compensation. The Convention on Biological Diversity, adopted at the 1992 Earth Summit in Rio de Janeiro, is the only international legal instrument setting out obligations for sharing the benefits derived from the use of biodiversity. The CBD excludes human genetic resources from its scope, however, this article considers whether it should be expanded to include those resources, so as to (...) enable research subjects to claim a share of the benefits to be negotiated on a case-by-case basis. Our conclusion on this question is: 'No, the CBD should not be expanded to include human genetic resources.' There are essential differences between human and non-human genetic resources, and, in the context of research on humans, an essentially fair exchange model is already available between the health care industry and research subjects. Those who contribute to research should receive benefits in the form of accessible new health care products and services, suitable for local health needs and linked to economic prosperity. When this exchange model does not apply, as is often the case in developing countries, individually negotiated benefit sharing agreements between researchers and research subjects should not be used as 'window dressing'. Instead, national governments should focus their finances on the best economic investment they could make; the investment in population health and health research as outlined by the World Health Organization's Commission on Macroeconomics and Health; whilst international barriers to such spending need to be removed. In this article, we examine scholarly analyses of justice and develop a framework that can help assess the claims from the parties in the Russian state-led doping scandal, including, but not limited to, Russian athletes, non-Russian athletes, the World Anti-Doping Agency, and sport governing bodies. The two key components of this justice framework are pluralism and relationality/contextuality. We argue that a justice framework built upon these elements better captures the nature of justice. We conclude that no party in the Russian (...) state-led doping case has exclusive access to justice. Rather, all the parties have legitimate calls for justice against one another. Thus, the administration of justice will fail to serve justice, in its different meanings, for all parties. (shrink)

The development of information and communication technologies offers innovative opportunities to establish business strategies focused on customer value co-creation. This situation is especially notable in the banking industry. e-Banking activities can support competitive advantages. However, the adoption of e-banking is not yet well-established among consumers. In this sense, the technology acceptance model is considered essential in studying consumer behavior applied to adopt a particular technology. According to the TAM model, this study analyses the factors which influence bank customers to adopt (...) e-banking to facilitate their banking services and support the process of value co-creation. Consequently, the authors examine five main aspects of the technology adoption model to provide a broad understanding of bank customers’ consumption of e-banking. Education is a fundamental pillar in human development, and its evolution throughout history has been influenced by a variety of factors, including imaginative culture and human nature. In this study, we explore how educational methods have evolved in response to the interaction between these two aspects. We look at how human creativity, imagination, and adaptation have influenced the way we teach and learn, from early forms of knowledge transmission to more contemporary approaches focused on active student engagement and the development (...) of practical skills. Our research is based on a comprehensive review of the academic literature in the fields of education, evolutionary psychology, cultural anthropology, and imagination studies. We explore how societies have used imagination as a tool to transmit knowledge and values, as well as to foster creativity and individual expression. We also examine how adaptive aspects of human nature, such as the ability to learn collaboratively and adapt to changing environments, have influenced the way educational methods are designed. Our results show a clear evolution in educational methods over time, from approaches focused on the one-way transmission of knowledge to more interactive and participatory models that encourage exploration and discovery. We identify common patterns in the way societies have used imagination and adaptation to promote learning and socialization and discuss the implications of these findings for contemporary education. In conclusion, this study highlights the importance of understanding the relationship between imaginative culture, human nature, and education. It provides a solid foundation for the design of educational methods that harness the innate creativity and adaptability of human beings and offers guidance for educators and policymakers on how to promote meaningful and lasting learning in today's world. Dos místicos relativamente contemporáneos: Etty Hillesum y Benjamín González Buelta; dos estilos, dos contextos y una coincidencia establecida desde sus experiencias espirituales, en profunda conexión con la realidad, en medio de la vida y sus desafíos. Hillesum no habla propiamente de la experiencia mística, sin embargo, su proceso personal existencial en el duro contexto de guerra que le tocó vivir, la condujo a descubrirse profundamente habitada. Su experiencia de Dios le hizo posible comprender y gestionar el dolor en medio de (...) la guerra, así como la necesidad de ‘hacerse bálsamo sobre las heridas’ de sus hermanos judíos. Etty es una mística de ojos abiertos. Benjamín González Buelta ha profundizado en la comprensión de la mística, describiéndola y analizándola desde la experiencia de Dios en el contexto latinoamericano. Su reflexión permite hoy leer a Etty Hillesum desde la perspectiva del místico de ojos abiertos. (shrink)
